Care component
In order to qualify for the DLA Care component, a person must satisfy both disability tests and general conditions of entitlement.
It is paid at one of the three rates:
- High £67.00
- Middle £44.85
- Low £17.75
Claimants will get the high rate if they:
OR if they satisfy:
- one of the day conditions AND
- one of the night conditions
Claimants will get the middle rate if they satisfy:
- one of the day conditions OR
- one of the night conditions
Claimants will get the low rate if they satisfy:
- one of the part-time day conditions
The Disability Tests - Care
You must show that you are so severely disabled physically or mentally that you require from another person:
During the Day
- frequent attention throughout the day in connection with your bodily functions OR
- continual supervision throughout the day in order to avoid substantial danger to yourself or others.
During the Night
- prolonged or repeated attention in connection with your bodily functions OR
- in order to avoid substantial danger to yourself or others you require another person to be awake for a prolonged period or at frequent intervals for the purpose of watching over you.
Part-Time Day Care
- in connection with your bodily functions attention from another person for a significant portion of the day (whether during a single period or a number of periods) OR
- you cannot prepare a cooked main meal for yourself if you have the ingredients.
General conditions
Qualifying periods - Claimants must:
- have satisfied the disability test(s) for 3 months before the claim AND
- be likely to continue to satisfy the test(s) for 6 months after the claim.
Residence - Claimants must:
- Terminal illness - present + ordinarily resident, NOT subject to immigration control.
- be ordinarily resident in Great Britain AND
- be present in Great Britain AND
- have been present in Great Britain for 26 out of the last 52 weeks
- babies who have been present in Great Britain for 13 out of the last 52 weeks.
Age
There is no lower age limit for DLA Care component.
Claimants may apply for the Care component up to the day before their 65th birthday.
Under 16 - There is an extra disability test for children; as well as satisfying one of the disability tests it must be shown that:
- they need attention or supervision 'substantially' in excess of the normal requirements of a person of the same age OR
- they need substantial attention or supervision which younger persons in normal physical and mental health may also have but which persons of the same age and in normal physical and mental health would not have.
